Nayarit’s Bullfights and Cockfights Are No Longer “Cultural Heritage”

The Supreme Court of Justice of the Nation (SCJN) resolved that the bullfights and cockfights are not “intangible cultural heritage” of the state of Nayarit.

The civil association “Cuenta Conmigo Tepic” requested an injunction so that both activities would not be considered as cultural since “animals are mistreated, tortured and even killed.”

With the above, a decree issued in Nayarit in 2019 in which bullfighting and cockfighting were declared “intangible cultural heritage” of the state is invalidated.

“This Chamber considers that cockfights and bullfighting, when translated into activities that generate suffering, agony and even the death of sentient species, in an unnecessary or unjustified manner, are incompatible or irreconcilable with the human right to a healthy environment. and, therefore, they are not subject to protection under the so-called cultural rights,“ said the SCJN.

“Amparo is granted to the complaining party for the purpose of declaring the claimed Decree unconstitutional, with general effects.”

However, the SCJN clarified that said resolution is only to resolve that it is not a cultural event: “this ruling does not imply that the ‘bullfighting and cockfighting’ should be prohibited in our country. That is a question that was not raised in this case. The only conclusion of that sentence is that these activities cannot be protected by the so-called cultural rights.”

Arturo Berlanga, director of Animanaturalis in Mexico, indicated that the association that presented the amparo has yet to seek a reform of the Animal Protection Law and that the exception to bullfighting be removed.
